Late-term abortions — for any reason

Prop 1 is a backdoor attempt to rewrite Idaho law and legalize late-term abortions, well beyond when a baby is capable of feeling pain.

Prop 1 explicitly establishes a right to abortion “up to fetal viability…” That’s long past the point that a baby can feel pain. And Prop 1 goes even further, deceptively redefining “fetal viability” to authorize late-term abortions well into the seventh or eighth month.

Eliminates parental consent.

Prop 1 overturns parental consent requirements, authorizing healthcare providers to perform abortions on teenage girls behind the backs of their parents.

Prop 1 overrides Idaho’s parental consent law, creating a right to abortion for “every person” regardless of age. That means abortion would be the only procedure that can be performed on a child without her parents’ permission — gutting parental rights.

Tricky language written to deceive voters.

Prop 1 claims to allow abortions only to the point of “viability." But Prop 1’s fine print redefines “viability,” permitting abortion-on-demand for any reason through seven or even eight months of pregnancy.

Idaho law has always defined “fetal viability” as the point at which a preborn baby could “potentially live outside the mother’s womb, albeit with artificial aid,” which has traditionally been understood to mean 20–24 weeks into a pregnancy. But Prop 1 would radically redefine “fetal viability”, authorizing late-term abortions until a baby has a “significant likelihood of sustained survival outside of the uterus without extraordinary medical measures.” This means that preemie babies needing the aid of oxygen, nutrition, or other extraordinary measures to survive would no longer be considered viable — going far beyond Roe v Wade.

Eliminates safety requirement that only doctors can perform abortions.

Prop 1 permits any health care providers – who are not doctors – to perform abortions, gutting women’s health protections.

Prop 1 purports to create a right to abortion “in consultation with a health care provider,” which is defined as any “licensed person or an entity that provides health care or medical treatment.” This definition is broad enough to include healthcare providers who aren’t doctors — and even abortion clinic employees.
