What is Prop 1?

Prop 1 is being sold as a “return to Roe,” but the fine print goes much further than most voters realize. Here’s a plain-language rundown of what’s hidden in the text of the initiative:

What Prop 1 would do

Prop 1 would establish a right to abortion on demand up to “fetal viability.” That sounds like a familiar limit, but Prop 1 changes what viability means.

It redefines viability. Idaho law has long defined “viability” as the point where a baby could survive outside the womb with medical help. Prop 1 replaces that with a new standard: a “significant likelihood of sustained survival outside of the uterus without extraordinary medical measures.” Under that wording, a premature baby who needs oxygen or NICU support to survive would no longer count as viable. That pushes the line into the seventh or eighth month of pregnancy.

It removes parental consent. Prop 1 grants the right to “every person,” with no age limit. That would override Idaho’s parental consent law, so a minor could have an abortion without her parents knowing.

It doesn’t require a doctor. Prop 1 ties the right to consultation with a “health care provider,” defined broadly as any licensed person or entity providing medical care. That includes people who are not physicians, and could include abortion clinic staff.

Why it matters

Prop 1 isn’t what it seems. Voters are being told it simply restores a viability limit, but the redefinition allows late-term abortion for any reason, well past the point a baby can feel pain. That goes further than Roe v. Wade ever did.

It also takes decisions away from Idaho parents. Abortion would become the one procedure in Idaho that could be performed on a child without her parents’ permission.

And it weakens safety protections for women by removing the requirement that a doctor perform the procedure. Taken together, Prop 1 is too extreme for Idaho.

What you can do

Vote No on Prop 1. A No vote keeps Idaho’s current definition of viability, its parental consent law, and its requirement that doctors perform abortions.
